Definitions

Customer is the body who has booked and paid for the trip via SommaiFishingTour.com.

Tour Agent is Hello Andaman Tours who is the middleman between the customer and the Tour Operator. The trip agent has the moral responsibility towards the customer.

Tour Operator is Sommai Fishing Tour, the body who is responsible for the trip and who is organizing and operating the trip and hotel transfer. The tour operator has the legal responsibility towards the customer.


Cancellation Policy

Customer Cancellation
All bookings must be cancelled by e-mail to contact@sommaifishingtour.com only. A confirmation of the cancellation will be sent to the customer by e-mail.

No charges will be applied to cancellations that are requested before 19.30 on the day from that the payment was made.

A 2.7% charge will be applied to cancellations that are requested after 19.30 on the day and onwards, from that the payment was made.

A 300 THB + 2.7% charge will be applied to cancellations that are requested 7 days after that the payment was made.

*In some cases an exchange fee charge of 2% also might be applied.

- Cancellations made 72 hours before a trip and same day as payment was made (before 19.30) will not be subject to any charges. Otherwise, please see above under 'charges'.

- Cancellations made 48 hours before a trip and same day as payment was made (before 19.30) will be subject to a charge of 50%. Otherwise, please see above under 'charges'.

- Cancellations made 24 hours before a trip and same day as payment was made (before 19.30) will be subject to a charge of 100%. Otherwise, please see above under 'charges'.

*Refunds may take up to 7 days for the money to reach the customer's bank account.

Tour Operator/Tour Agent Cancellation
Should the Tour Operator cancel the trip anytime prior to the trip day, the customer will be offered the trip on another day or offered a 100% refund of the amount that customer paid (no charges applied).

Bookings Made at least 4 Days Before Trip
Tour Agent has the right to cancel the trip if the customer fails to complete payment (full deposit payment for charter trip, full total payment for join-in fishing trip) not later than 72 hours prior to the trip, to which payment has to be done through Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link only. Valid only for bookings made at least 4 days before trip.

Bookings Made Less than 4 Days Before Trip
Tour Agent has the right to cancel the trip if the customer fails to complete payment (full deposit payment for charter trip, full total payment for join-in fishing trip) not later than 24 hours prior to the trip, to which payment has to be done through Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link only. Valid only for urgent bookings made less than 4 days before trip.

For charter trips, should customer be unable to pay full remaining amount by cash, via Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link on the day of the trip, before boarding the boat charter, the Tour Operator/Tour Agent has the right to cancel the trip and keep 100% of the deposit.


Change Policy

Customer Change
Most changes to a charter trip such as date (depending on availability), small itinerary adjustments etc. are free of charge and must be communicated via e-mail to contact@sommaifishingtour.com not later than 24 hours prior to the trip.


Tour Operator Change
Tour itinerary and pickup/drop off times are approximate and might change depending on how much time is left on the trip or based on weather/sea conditions.


Join-In Tour

If total customers booked on a Join-In Tour does not reach a minimum of 8 people, the Tour Agent will use a partner Tour Operator instead.


No Show

1. Should the customer not be present for pick-up at the place and time specified in the confirmation email, or does not go on the trip for other reasons, no refund is applicable no matter the reason (including medical reasons) and any claims need to be submitted by the customer to the customer's travel insurance company.

2. Should the customer choose to provide own transportation to the trip, a map will be attached to the confirmation email and a meetup time will be specified. In the case of failure to arrive at the specified location at the meetup time and the trip cannot be provided, no refund is applicable.

3. Should the Tour Operator fail to pick-up the customer, the customer must contact us at contact@sommaifishingtour.com or Sommai Fishing Tour Facebook, no later than 30 minutes after the specified pick-up time. Should the Tour Operator claim that they were at the place and time specified in the confirmation email and we have not received such a email or chat message from the customer no refund is applicable.


Claims

1. Any claims in regards to a trip/tour must be communicated by e-mail by the customer not more than 10 days after the trip/tour date.

2. Any personal incident/inconvenience caused by Tour Operator that may lead to a claim must be reported to Sommai Fishing Tour at the time of occurrence by contacting us at contact@sommaifishingtour.com.

3. Any refund due to an incident/inconvenience that has been fulfilled by paragraph 1 and 2 can only be granted if the incident/inconvenience is verifiable by us, the Tour Operator agrees to grant a refund.

4. Any refund due to an incident/inconvenience can only be given if such incident/inconvenience was proven to be caused by the Tour Operator.

5. Any refund will be paid back in the same way as the trip was paid for.


Trip/Tour Confirmation

Charter Trip

1. After deposit payment has been made, the customer will receive a confirmation by e-mail within 15 min after payment, to the e-mail address specified by the customer at the time of booking. It is the sole responsibility of the customer to check that such an e-mail has been received and contact us contact@sommaifishingtour.com immediately if it has not been received.

2. Any refusal to pay transfer fee and national park fee claiming that such information was not specified on the website or that a trip confirmation with such payment information has not been received will result in refusal to participate in the trip and transportation back to the customer's hotel will be born entirely by the customer and no refund of the trip payment will be granted.

3. The above is also applicable for cancellation and changes to a trip requested by the customer as an updated confirmation email will be sent to the customer.


Join-in Tour

1. After full payment has been made, the customer will receive a confirmation by e-mail within 15 min after payment, to the e-mail address specified by the customer at the time of booking. It is the sole responsibility of the customer to check that such an e-mail has been received and contact us contact@sommaifishingtour.com immediately if it has not been received.


Trip/Tour Payment

Charter Trip

1. After a booking has been processed and approved by us, the customer will receive a link to pay a deposit of 5,000 THB. Said link will be sent to the email provided in the booking. The customer has to pay the full deposit via Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link only. The Tour Agent has the right to cancel a booking if the deposit has not been paid before a specified time:
1. 72 hours before booked trip date for Bookings Made at least 4 Days Before Trip
2. 24 hours before booked trip date for Bookings Made Less than 4 Days Before Trip

2. The remaining amount has to be paid on the day of the trip prior to boarding the boat charter, at Chalong Pier. The customer has to pay with cash (THB only)/via Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link

If customer is unable to pay full remaining amount before boarding, the Tour Operator/Tour Agent has the right to cancel the trip and keep 100% of the deposit.

Join-in Tour

1. After booking, the customer will receive a link to Hello Andaman Tours PaySolution payment link or Sommai Fishing Tour Stripe Payment link to pay full amount for the trip/tour.

2. The Tour Agent hasthe right to cancel a booking if full amount of the join-in tour has not been paid before a specified time:
1. 72 hours before booked trip date for Bookings Made at least 4 Days Before Trip
2. 24 hours before booked trip date for Bookings Made Less than 4 Days Before Trip

It is the sole responsibility of the customer to review their booking/trip details and total price, before paying. Any corrections of trip details have to be sent to contact@sommaifishingtour.com only prior to paying.

Payment Gateway Available
Depending on the trip/tour type, a Stripe payment link or PaySolution payment link will be sent to you via email from us. Stripe which is used by international businesses like Amazon and Shopify as well as another trusted payment gateway PaySolutions which is used by Marriot Hotels and Dior.

Join-in Tours - Credit/Debit card and PromptPay


Pregnant Women

Due to safety of both woman and child, pregnant women are not allowed on any trip. Should the Tour Operator refuse access to the trip/tour due to pregnancy, no refund is applicable.


Children and Elderly

Children under 1 years old and persons over 70 years old are not allowed on any trip. Should the Tour Operator refuse access to the trip/tour due to the age limits, no refund is applicable.


National Park Fee and Island Admission Fee

Any National Park fees, docking fees or island admission fees are paid by the customer to the park/island ranger directly and no refund is applicable.


Tour Operator/Tour Agent's Disclaimer

Hotel Transfer
Hotel transfer service is included in all fishing trip bookings for specific areas which are Patong, Chalong, Kata, Karon, Rawai only. Other areas, an addtional charge for hotel transfer is applied. By submitting your booking via https://www.sommaifishingtour.com/phuket-fishing-trips/book-trip you accept the hotel transfer rates that are applied, displayed at the top of the page under "Booking Summary".

The trip/tour program is subject to change dependent on weather and sea conditions. In such a case no compensation is applicable. Customer will be notified in the morning of trip by email and asked to either change the date or accept a 100% refund of the amount that customer paid (no charges applied).

Tour Agent will not offer any refund at all to anybody whom we found has been trying to get a refund in a fraudelent or abusive manner.

Jigging and popping fishing techniques cost an additional 3000 THB per day and are only offered on medium-large class boats. Availability depends on our pro fisher, be sure to request at least 48 hours in advance of trip.

Tour Operator/Tour Agent cannot guarantee the amount/type of fish that will be caught during the trip/tour.

Tour Operator/Tour Agent has the right to change boat depending on boat's availability without prior notice.

Tour Operator/Tour Agent has the right to use a partner Tour Operator for Join-In Tours if total customers booked for a trip hasn't reached a min. of 8 people, without prior notice.
